Across energy, environmental regulation, infrastructure, and public lands matters, the Trump Administration has deployed novel legal interpretations, executive orders, and aggressive administrative actions to displace traditional areas of state authority. While each of these actions may initially appear distinct, they reflect a recurring, coordinated pattern. Disputes over a pipeline, an offshore wind project, or a power plant are often better understood as pieces of a broader strategy to concentrate decision-making authority within the presidency at the expense of Congress, the states, and other institutions. Recognizing that recurring pattern gives litigators a common playbook against which to develop a coordinated strategy.
